AP saleroom Seller Terms and Conditions

AP saleroom is the trading name of The Advertising and Petroliana Saleroom Ltd, a company registered in England and Wales, Company Number 16447625.

These Seller Terms and Conditions apply to all Lots consigned for sale by AP saleroom, whether sold through live auctions, timed auctions, or post-auction sales, including “and the sale goes on” listings.

1. Definitions

Consigning Lots Form: The form completed by the Seller detailing Lot descriptions, estimates, reserves, and auction duration.

Contract: The agreement between the Seller and the Buyer, with AP saleroom acting as agent.

Hammer Price: The final bid price in pounds sterling at which a Lot is sold.

Lot or Lots: Any item consigned for sale through AP saleroom.

Sale: Any live auction, timed auction, or post-auction sale operated by AP saleroom.

Sale Proceeds: The net amount payable to the Seller after deduction of commission, fees, expenses, and any applicable VAT.

Seller: The individual or entity offering the Lot for sale.

2. Commissions and Fees

2.1 Standard Seller commission is 10% of the Hammer Price.

2.2 Commission may reduce to 5% for Lots or parcels totalling £20,000 or more, subject to written agreement.

2.3 A cataloguing fee of £5 per Lot sold applies.

3. Identification and Compliance

3.1 Sellers must provide photographic identification and proof of address where required.

3.2 Source of funds information may be requested for higher value consignments.

4. Payment to Sellers

4.1 Sale Proceeds will be remitted within seven days of receipt of cleared Buyer funds.

4.2 AP saleroom is not liable for Buyer default. In such cases, AP saleroom may resell the Lot, sell to an underbidder, or offer the Lot through post-auction sale channels.

4.3 Any shortfall or costs arising from Buyer default may be deducted from Sale Proceeds.

5. Exclusivity

5.1 All Lots are consigned exclusively and must not be offered elsewhere during the consignment period.

6. Withdrawals and Storage

6.1 Lots may be withdrawn with written notice no later than 72 hours before going live.

6.2 A withdrawal fee applies equal to 10% of the estimate or £25, whichever is greater.

6.3 Storage and handling charges apply after seven days following the Sale.

7. Seller Warranties and Liability

7.1 The Seller warrants good title and authority to sell.

7.2 Mechanical and electrical items are sold as decorative only.

7.3 In the event of a successful forgery or misdescription claim, the Seller shall refund the Hammer Price.

7.4 AP saleroom liability is limited to the lower of the Hammer Price or pre-sale estimate.

7.5 Estimates are opinions only and are not guarantees of selling price.

8. Force Majeure

8.1 AP saleroom shall not be liable for failure to perform any obligation caused by circumstances beyond its reasonable control, including but not limited to fire, flood, theft, platform outage, or other events of force majeure.

9. Data Protection

9.1 AP saleroom processes Seller data in accordance with its Privacy Policy, in compliance with GDPR and other applicable data protection laws.

10. Governing Law and Precedence

10.1 These Terms are governed by the laws of England and Wales.

10.2 In the event of any inconsistency between these Terms and any catalogue, listing, or online description, these Terms shall prevail.
