AP saleroom Buyer Terms and Conditions

AP saleroom is the trading name of The Advertising and Petroliana Saleroom Ltd, a company registered in England and Wales, Company Number 16447625.

These Buyer Terms and Conditions apply to all auctions conducted by AP saleroom, whether live or timed, and to any subsequent post-auction sales, including listings made available through the “and the sale goes on” function on the AP saleroom website or associated platforms.

1. Definitions

  • Buyer: The person or entity whose bid is accepted at the conclusion of an auction or who agrees to purchase a Lot through a post-auction sale.

  • Buyer’s Commission: The commission payable by the Buyer in addition to the Hammer Price. AP saleroom charges a Buyer’s Commission of 16%.

  • Contract: The contract formed between the Seller and the Buyer, with AP saleroom acting as agent.

  • Hammer Price: The final bid price in pounds sterling at which a Lot is sold at the conclusion of an auction or agreed post-auction sale.

  • Lot or Lots: Any item offered for sale through AP saleroom.

  • Reserve: The minimum Hammer Price agreed between AP saleroom and the Seller.

  • Sale: Any live auction, timed auction, or post-auction sale operated by AP saleroom, including “and the sale goes on” listings.

  • Seller: The person or entity offering a Lot for sale through AP saleroom.

  • Total Amount Due: The Hammer Price plus Buyer’s Commission, any applicable internet bidding fees, storage, handling, transport, or other charges.

  • VAT: United Kingdom Value Added Tax at the prevailing rate, if applicable.

2. Registration and Bidding

2.1 All Buyers must register and be approved before bidding or purchasing.

2.2 Buyers must provide valid photographic identification. Where a passport is provided, proof of address will also be required.

2.3 AP saleroom reserves the right to request additional verification, including source of funds information.

3. Contract Formation

3.1 A Contract is formed at the conclusion of an auction for that Lot or when a post-auction sale is agreed.

3.2 The Buyer accepts full responsibility for the Lot upon Contract formation.

4. Commission and Fees

4.1 Buyer’s Commission is charged at 16% of the Hammer Price.

4.2 Internet bidding fees apply as follows:

  • AP saleroom in-house platform: 2%

  • The Saleroom platform: 4.95% plus VAT, where applicable

  • Commission, room, or telephone bids: no additional surcharge

5. Payment

5.1 Payment is due by bank transfer only and must be received within 72 hours of the conclusion of the Sale.

5.2 AP saleroom will issue invoices within 24 hours where practicable.

5.3 Title to the Lot does not pass to the Buyer until full payment is confirmed as received in AP saleroom’s bank account. For immediate collection, payment must be visible in our account at the time of handover.

6. Buyer Default

6.1 If the Buyer fails to pay within the required period, AP saleroom may:

  • Cancel the sale

  • Resell the Lot

  • Sell to an underbidder

  • Offer the Lot through a post-auction sale

6.2 The defaulting Buyer shall be liable for any shortfall, resale costs, storage, and administrative expenses.

6.3 Non-paying Buyers may be banned from future sales.

7. Risk and Collection

7.1 Risk passes to the Buyer at the conclusion of the Sale.

7.2 Complimentary storage is provided for seven days following the Sale. Thereafter, storage and handling charges may apply, whether provided by AP saleroom or a third party.

7.3 For same-day collection, Lots will only be released once payment is visible in our account. We recommend using mobile banking on-site to facilitate immediate handover.

8. Descriptions and Condition

8.1 All catalogue descriptions, estimates, and condition reports are statements of opinion only and do not constitute warranties.

8.2 Buyers are responsible for satisfying themselves as to condition, authenticity, and suitability prior to bidding or purchase.

8.3 Estimates are opinions only and are not guarantees of selling price.

9. Forgeries and Claims

9.1 Claims relating to forgery or significant misdescription must be raised within 14 days of the Sale, or such longer period as required by law.

9.2 If a claim is upheld, the sale may be rescinded and refunded upon return of the Lot.

10. Liability

10.1 AP saleroom acts as agent only and shall not be liable beyond the Hammer Price.

11. Force Majeure

11.1 AP saleroom shall not be liable for failure to perform any obligation caused by circumstances beyond its reasonable control, including but not limited to fire, flood, theft, platform outage, or other events of force majeure.

12. Data Protection

12.1 AP saleroom processes Buyer data in accordance with its Privacy Policy, in compliance with GDPR and other applicable data protection laws.

13. Governing Law and Precedence

13.1 These Terms are governed by the laws of England and Wales.

13.2 In the event of any inconsistency between these Terms and any catalogue, listing, or online description, these Terms shall prevail.
